FujiMuse Terms of Service

1. Acceptance of Terms

By downloading, installing, or using FujiMuse ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

FujiMuse is a mobile application that provides:

• Fujifilm camera recipe management and organization
• AI-powered recipe suggestions and chat assistance
• Visual recipe preview generation
• Social features for sharing photos and recipes
• Recipe synchronization and export capabilities

3. Account Registration

3.1 Requirements

• You must be at least 13 years old to create an account
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account

3.2 Account Responsibilities

• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access
• You may not share your account credentials with others

4. Subscription Services

4.1 Subscription Tiers

• Free: Recipe library, community browsing, recipe sharing, and limited visual previews. AI chat requires Pro.
• Pro: 50 AI chat messages per day, 50 visual previews per day, and up to 500 saved recipes. A one-time lifetime Pro purchase may also be offered.
• Creator: 200 AI chat messages per day, 200 visual previews per day, unlimited saved recipes, and everything in Pro.

4.2 Billing

• Subscriptions and one-time digital-feature purchases are billed through the Google Play Store
• Prices are subject to change with notice
• Refunds are handled according to Google Play policies

4.3 Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds for partial periods

5. User Content

5.1 Your Content

You retain ownership of content you create and upload ("User Content"). By posting User Content, you grant FujiMuse a worldwide, non-exclusive, royalty-free license to:

• Display, distribute, and reproduce your content within the App
• Use your content for promotional purposes
• Create derivative works for service improvement

5.2 Content Guidelines

You agree not to post content that:

• Infringes intellectual property rights
• Is illegal, harmful, or offensive
• Contains malware or harmful code
• Violates others' privacy
• Is spam or misleading
• Impersonates others

5.3 Content Moderation

We reserve the right to remove any content that violates these Terms without notice.

6. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's operation
• Reverse engineer or decompile the App
• Use automated systems to access the App
• Circumvent usage limits or rate limiting
• Resell or redistribute the App or its content
• Harass, abuse, or harm other users

7. AI Features

7.1 AI Chat

• AI responses are generated by third-party services through FujiMuse's server-side proxy
• Responses are creative guidance and informational starting points only
• We do not guarantee the accuracy of AI-generated content
• You should verify camera compatibility and settings before applying them

7.2 Preview Generation

• Generated previews are approximations and directional comparisons
• Actual camera results may vary by camera model, firmware, lens, light, JPEG settings, and taste
• Generated images are for personal use within the App

8. Intellectual Property

8.1 Our Property

The App, including its design, features, and content (excluding User Content), is owned by FujiMuse and protected by intellectual property laws.

8.2 Trademarks

"Fujifilm" and related camera model names are trademarks of FUJIFILM Corporation. FujiMuse is not affiliated with or endorsed by FUJIFILM Corporation.

8.3 Recipe Sharing

When you share a recipe:

• You grant recipients the right to use the recipe
• Attribution should be maintained where provided
• Commercial use restrictions may apply

9. Third-Party Services

The App integrates with third-party services including:

• AI chat services, currently Google Gemini primary and Anthropic Claude fallback
• AI image processing services, currently Replicate for AI-enhanced preview
• Supabase (backend services)
• Google Play Billing (payment processing)

Your use of these services is subject to their respective terms and policies.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

11. Disclaimers

11.1 As-Is Basis

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

11.2 No Guarantee

We do not guarantee that:

• The App will be uninterrupted or error-free
• AI-generated content will be accurate
• Recipe previews will match actual camera output
• The App will meet your specific requirements

11.3 Camera Compatibility

Recipe settings may not be compatible with all Fujifilm camera models. Verify compatibility before applying settings.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to amounts you paid us in the past 12 months
• We are not responsible for any damage to your camera or equipment

13. Indemnification

You agree to indemnify and hold harmless FujiMuse from any claims arising from:

• Your use of the App
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

14. Termination

14.1 By You

You may terminate your account at any time by deleting it through the App settings.

14.2 By Us

We may suspend or terminate your account for:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• At our discretion with notice

14.3 Effect of Termination

Upon termination:

• Your license to use the App ends
• Your User Content may be deleted
• Provisions that should survive will continue

15. Dispute Resolution

15.1 Informal Resolution

Before filing a claim, you agree to contact us and attempt informal resolution.

15.2 Arbitration

Any disputes will be resolved through binding arbitration, except for small claims court matters.

15.3 Class Action Waiver

You waive any right to participate in class action lawsuits or class-wide arbitration.

16. General Provisions

16.1 Governing Law

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles.

16.2 Severability

If any provision is found unenforceable, the remaining provisions continue in effect.

16.3 Entire Agreement

These Terms constitute the entire agreement between you and FujiMuse.

16.4 Waiver

Failure to enforce any right does not waive that right.

16.5 Assignment

We may assign these Terms. You may not assign without our consent.

17. Changes to Terms

We may modify these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be notified through the App or email.
